Overview

Purchasing Products
All Independent Business Owners purchase products directly from Amway France.

Bonus and Commission Payment
Commissions are paid directly to the Independent Business Owner who has earned the commission. Bonus payments will be paid by the 15th of the month in a direct payment on the ABO's bank account.  Sales Bonuses (France has a single price model, which means ABOs earn Retail Margins) are paid weekly.

PV/BV Transfers
PV/BV transfers are not available except for Independent Business Owners residing in a DOM (Martinique, Guadeloupe, Guyane, Réunion).

Single Line of Sponsorship
Germany and France operate as a single line of sponsorship. International sponsoring is not allowed between these two countries. Business volume generated in both countries will be consolidated for yearly qualifications and bonus purposes. This Single Line Of Sponsorship is used for personal sponsoring and bonus calculation (since March 2002). All businesses prior to this date are under the International sponsor rules (benefits for annual bonus calculation only for Emeralds and above).

Retail Margin
Retail margin or mark up for Amway products averages about 30% but varies with each product.

Starter Kit Purchasing
Independent Business Owners only have to order the Amway Sponsor Kit (Kit: « Démarrez l'activité Amway »). This process introduces prospects to the Amway Business opportunity with a minimum investment to the Sponsor.

The new Independent Business Owner will receive the Amway Sales Kit directly from Amway. He may also order additional products by adding the items to the order form enclosed in the Amway Sponsor kit (Kit : « Démarrez l'activité Amway »). This Kit should be ordered within the first 30 days after the registration.

Payments can be made through bank transfer, check, cash transfer (via bank), credit card (MasterCard or VISA) and direct debiting (in case Amway has received a valid direct debit mandate and has approved).

Cost of Sales Kit
The kit (Kit : « Démarrez l'activité Amway »):  30 Euro including VAT (25 Euro including VAT) 

Sponsoring
In order to sponsor someone interested in the Amway Sales and Marketing Plan, the Independent Business Owner has register the prospect on Amway online (www.amway.fr).  This is the only option to register.  There is no offline applicaiton anymore.  

Business Type

I - Independent Business Owner (IBO)
This is the business builder, eligible to register other Independent Business Owners, merchandise, receive Performance Volume Bonuses, Service Commissions and take advantage of all of the benefits of owning an Amway business.

MA-Marketing Advisor:
A status which allows European Independent Business Owners to sponsor. It does not provide for combining volumes between markets for purposes of bonus calculations.

Eligibility:
Platinum Pin and above in any of the markets listed below. Diamond Pin in any existing Amway market that has multiple businesses in any of the markets participating in the program.

Participating Markets:
If you have a traditional Amway business and local address in one of the below countries (home market) you can have businesses in the remaining countries (marketing advisor countries) as a Marketing Advisor.

Austria, Hungary, Netherlands/Belgium, Spain/Portugal, Germany, United Kingdom, Czech Republic, Poland, Switzerland, France, Italy, Slovenia, Croatia, Slovakia, Romania, and Scandinavia (Denmark, Finland, Norway, Sweden)

Benefits:
- Receive individual MAM commission checks in your home country in home currency
- Minimal business and tax registration and reporting requirements
- Maintain and develop lines of sponsorship within each market
- Renewing businesses in the home country will automatically renew your Marketing Advisor Businesses

Establish a Second Business

International Sponsoring
International sponsoring is always an option and an excellent means of expanding your business while avoiding many of the costs and complexities associated with establishing a second business. Please note: For those markets where foreigners are able to establish a second business, they must be the international sponsor of their second business in another country.

Establishment of a second business involves complex business and legal issues. Amway Business Owners should always contact the affiliate and obtain the advice of a local attorney before attempting to establish a second business.

Business Entities
Amway Business Owners may establish a second business in France. The most common forms of businesses are: Independent Worker status and Limited Liability Company (SARL). To set up an SARL, various legal formalities must be accomplished. Most filings are accomplished by means of a single declaration filed at the local Corporate Formalities Center (Centre de Formalités des Enteprises) which will transfer the information contained in such declaration to the appropriate authorities (Register of Commerce and Companies, Social Security Administration, Tax Authorities, etc.). Such declaration must be accompanied by documents required by the governmental authorities (Articles of Incorporation, etc.). You should consult with a local attorney to identify the best business form to accomplish your business goals. If you wish to operate in a form other than Independent Worker, you should contact the affiliate to discuss Amway’s policy concerning the formation of the business entity. Social Insurance (no trade license necessary), a local bank account and local address are required.

Visa Requirements
As a general rule, foreigners intending to do business in France (except for citizens of the European Economic Area (the European Economic Area or “EEA” comprises 28 countries: (i) the 28 Member States of the European Union* and (ii) Norway, Iceland and Lichtenstein) and citizens of Switzerland) must apply for a residence card or temporary residence permit within 2 months of entry into France. Moreover, foreigners intending to do business in France (except for citizens of EEA and OECD countries and certain other categories of persons) must obtain a commercial card. A temporary residence permit is issued to foreigners who have entered into France for a limited period of time or who intend to establish permanent residence in France but do not currently satisfy the conditions for the granting of a residence card. A temporary residence permit is valid for no more than one year and may be renewed.

* However, under European Union transitional measures, the exception does not yet apply to citizens of those new Member States which entered into the European Union on May 1, 2004: Cyprus, Czech Republic, Estonia, Hungary, Latvia, Lithuania, Malta, Poland, Slovak Republic, Slovenia.

A residence card may be issued to non EEA foreigners only if they can prove that they have legally resided in France for an uninterrupted period of three years. It is valid for 10 years and automatically renewed upon the request of its holder. The residence card confers automatically the right to work in France.

As a general rule, foreigners (with the exception of EEA and OECD nationals, persons who have been granted a residence card, and nationals of Algeria, Andorra and Monaco) and who are traders (sole proprietorship, partners of partnerships) or who intend to become the managing director of a SARL having its registered office in France must also apply simultaneously for a commercial card.

If, at the time of application, the applicant resides abroad and wishes to reside in France, such applications (commercial card and temporary residence permit) should be filed simultaneously with the nearest French consulate located in the country of residence.

Temporary resident permits together with commercial cards are valid for renewable one year periods.

The French consulate in the country of residence should be contacted in advance to obtain a general idea of the appropriate immigration requirements for your business purposes. Laws relating to visa requirements are constantly changing. Amway Business Owners must consult experts in the country to obtain advice on appropriate immigration requirements. Consulting an expert is also important, if you do not intend to reside there.

Amway Business Owner Registration Requirements
There is no registration requirements for French Amway Business Owners when starting an Amway activity. They only need to provide their Social Insurance Number (from France). French Amway Business Owners get a VDI status (Vendeur à Domicile Indépendant) when signing a contract with Amway.

Commercial Registry will be necessary when the Amway business represents the main activity.

The costs associated with the registration are around 3049 Euro the first year (social taxes).
